The website www.46parfums.com (hereinafter the "Website") is owned by the company 46 PARFUMS, a simplified joint-stock company with a capital of 1,000 euros, registered under the number 980041388 RCS Créteil, whose registered office is located at 10 rue de Conflans 94220 Charenton-le-Pont, France, represented by its legal representative (hereinafter "46 PARFUMS" or "We").
The Website allows any individual or entity to order a discovery experience related to perfumes (the "Experience").
These general terms and conditions of sale (hereinafter "GTC") apply to any purchase of one or more Experiences.
These GTC apply to any "Client" of 46 PARFUMS, regardless of their status:
- A consumer, understood as any natural person of legal age who acts for purposes that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity,
- A professional, understood as any natural or legal person, public or private, who acts for purposes within the scope of their commercial, industrial, craft, liberal, or agricultural activity, including when acting on behalf of or for another professional,
- A non-professional, understood as any legal entity that does not act for professional purposes. For the purposes of these GTC, a non-professional is considered as a consumer.
A "Client" in the context of these terms may be either the person who orders the Experience or the person(s) who participate in the Experience.
Certain provisions of these GTC, duly identified, apply only to a consumer Client or only to a professional Client, as the case may be. 46 PARFUMS therefore requests that you review these GTC in detail to determine which provisions apply to you, depending on your status as a consumer or a professional.
In accordance with the provisions of articles L. 112-1, L. 112-2, and L. 141-1 of the French Consumer Code, these GTC are made available to any purchaser for informational purposes prior to placing an order. For professional Clients, these GTC constitute, in accordance with article L. 441-1 of the French Commercial Code, the sole basis of the commercial relationship between the parties.
46 PARFUMS and the Client may hereinafter be referred to collectively as the "Parties" and individually as a "Party."
- ACCEPTANCE OF THE GENERAL TERMS OF SALE
The Client acknowledges having read these GTC no later than at the time of placing the order for one or more Experiences, and expressly declares to accept them without reservation. The Client's acceptance is materialized by a checkbox at the time of placing the order. These GTC shall prevail over any other terms contained in any other document, particularly any purchase conditions issued by the Client, unless expressly and in writing agreed between the Parties.
- PRESENTATION OF AN EXPERIENCE
An Experience under these GTC consists of an appointment during which the Client is personally received by Mr. Bruno Boussion in a predefined location for a moment of reflection and introspection, aimed at determining the olfactory identity of one or more Clients. At the end of the Experience, the perfume corresponding to the olfactory identity of each Client will be offered to them.
The Experience takes place in a location determined by 46 PARFUMS based on a profile chosen at the time of the order by the Client.
- PLACING AN ORDER
To place an order for an Experience, the Client must visit the Website and follow the order process, selecting the type of Experience desired, and then choosing a date. The Client can modify all of these elements until the order is officially placed. As part of the order process, the Client must provide certain personal information. Finally, the Client must pay the amount of the Experience in advance.
46 PARFUMS will confirm the acceptance of the Client's order by email to the email address provided by the Client during the order process. 46 PARFUMS will not be responsible if the order confirmation email cannot reach the Client due to a typing error.
46 PARFUMS reserves the right to cancel any order from a Client who lacks legal capacity or with whom there is a dispute, for example, related to payment of a previous order, or if false information was provided during the order.
46 PARFUMS will send an email, at the latest 24 (twenty-four) hours prior to the Experience, confirming the time and place where it will take place.
- CONDUCTING THE EXPERIENCE
The Experience takes place on the date and at the location indicated in the confirmation email sent by 46 PARFUMS, subject to any changes that may be necessary for reasons beyond 46 PARFUMS' control. In this case, 46 PARFUMS will notify the Client by email and/or phone of any potential changes as soon as possible before the Experience.
The Experience lasts for 3 (three) or 4 (four) hours depending on the type of Experience chosen: individual, duo, or group. The Client and any accompanying person(s) (if applicable) will engage in discussions with Mr. Bruno Boussion to better understand each individual's personality, energies, and their in-depth relationship with perfumes. These discussions will help identify the olfactory profile of the Client(s) and result in a recommendation for one or more exceptional perfumes that match the olfactory profile. A choice or choices, in the case of a group Experience, for one or more perfumes will be made by the Client, and the selected fragrance(s) will be offered to them as per Article 5 below ("Perfume").
- PERFUME
At the end of determining the Client's olfactory profile, 46 PARFUMS will offer the Client a perfume that it believes matches the profile, and will provide the Client with a bottle of the said perfume, which will be delivered by courier within 48 (forty-eight) hours after the Experience. If such a hand delivery proves impossible within this time frame, 46 PARFUMS will offer an alternative solution to the Client.
- EXCLUSION OF THE LEGAL RIGHT OF WITHDRAWAL
In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal is excluded for leisure activities that are to take place on a specific date or within a specific period.
Therefore, in accordance with the above, the order of an Experience cannot be subject to a right of withdrawal, except in the case of the acquisition of a gift card. In this latter case, the Client who purchased the gift card has the option to withdraw within 14 (fourteen) days from the order, if applicable, using the withdrawal form provided in the Annex. In this case, 46 PARFUMS will proceed with the refund of the price paid.
If the recipient of the gift card has booked their Experience within 14 (fourteen) days from the order, the right of withdrawal is automatically excluded. Indeed, the use of the gift card constitutes a waiver of the right of withdrawal.
- PRICE OF THE EXPERIENCE – PAYMENT
The price applicable to an Experience is the one displayed on the Website at the time of the order, expressed in euros and including all taxes according to the full French VAT rate. Prices may be changed at any time. Modifications are only applicable to orders placed after the new price becomes effective.
The price must be paid in full on the day of the order, exclusively by credit card. The transaction is carried out in a secure environment. The credit card number is only known by our banking partner.
The order validated by the Client will only be considered effective when the relevant payment center has approved the payment. If the payment center refuses, the order will be automatically canceled, and the Client will be notified by email.
- EXCLUSION OF LIABILITY – FORCE MAJEURE
As part of the services under these GTC, 46 PARFUMS is responsible for providing advice. It is under an obligation of means. Therefore, 46 PARFUMS' responsibility can only be engaged with the Client in the event that it has not implemented the means necessary to fulfill its obligations.
46 PARFUMS is not responsible for input errors during the Order. 46 PARFUMS is also not responsible for events related to the Client that prevent them from attending the Experience.
In accordance with article 1218 of the French Civil Code, any hindrance due to fire, epidemic, explosion, earthquake, bandwidth fluctuations, access provider failure, transmission network failure, collapse of installations, illegal use of passwords, codes or references given to the Client, hacking, power outage, war, embargo, request from any government, requisition, strike, or other circumstances beyond the reasonable control of 46 PARFUMS will be considered force majeure.
In such circumstances, 46 PARFUMS will be excused from performing its obligations within the limit and for the duration of the hindrance or limitation. In the event of force majeure preventing the Experience from taking place, 46 PARFUMS will offer an alternative date and/or location to the Client.
- EXCLUSION OF WARRANTY
The provision of the services under these GTC is not accompanied by any warranty other than the fulfillment of said services in accordance with the terms of the order. Specifically, 46 PARFUMS does not provide any warranty regarding the perfume that will be offered to the Client at the end of the Experience.
- DISPUTES
Any consumer Client has the right to refer to a consumer mediator for the amicable resolution of any dispute with a professional. 46 PARFUMS guarantees the Client effective access to a consumer mediation system. 46 PARFUMS has joined the Consumer Mediation Center of Conciliators of Justice (CM2C): www.cm2c.net.
Furthermore, the Client may refer to the mediator of their choice, whose contact details are available on the European Commission website: https://ec.europa.eu/consumers/odr
In the absence of an amicable agreement, the consumer Client may refer the matter to the court of their choice, according to the applicable rules.
In the event of a dispute with a professional Client, THE COMPETENT COURTS OF PARIS shall have exclusive jurisdiction, regardless of the place of delivery, the payment method accepted, or even in cases of third-party claims, multiple defendants, or emergency procedures (interim measures, short deadlines, petitions).
- PROTECTION OF PERSONAL DATA
46 PARFUMS complies with the provisions of the General Data Protection Regulation (GDPR) No. 2016/679 of April 27, 2016, and the French "Informatique & Libertés" law of January 6, 1978, as amended.
46 PARFUMS commits to respecting the confidentiality of personal data provided by Clients for the purpose of processing an order for an Experience, and agrees to process such data only for the needs of the said Experience.
Any Client who has provided personal data to 46 PARFUMS has the rights granted by the GDPR and the "Informatique & Libertés" law, including the right to access, rectify, delete, and oppose the processing of their data. The Client may also request the limitation of processing, request not to be subject to automated decision-making, and has the right to define the fate of their data after death. To exercise these rights, the Client can send an email to contact@46parfums.com.
The Client also has the right to file a complaint with the French Data Protection Authority (CNIL): www.cnil.fr.
- INTELLECTUAL PROPERTY
The Website and its content are original under French copyright law and intellectual property law, which the Client acknowledges. 46 PARFUMS owns or is licensed to use all content protected by intellectual property rights present on the Website.
Reproduction of any or all of this content (other than what is technically necessary for viewing it) on any medium is expressly prohibited. Reproduction of the Website is also expressly prohibited.
Using the content of the Website in violation of these provisions constitutes infringement under article L. 335-2 of the French Intellectual Property Code. In addition to civil damages, infringement is punishable by criminal sanctions, including a fine of 300,000 euros and/or 3 years in prison. For other uses, please contact 46 PARFUMS.
- CUSTOMER SERVICE
The consumer client has the option to contact 46 PARFUMS by email at the address contact(@)46parfums.com, in order to obtain information and/or for the processing of a complaint.
- MISCELLANEOUS
The fact that one of the Parties does not assert its rights under any of the provisions of the GTC does not affect its right to assert them later, at any time. The fact that one of the Parties does not assert a breach of any provision of the GTC does not constitute a waiver of its application later or a new breach or waiver of the provision itself.
A practice that deviates from the provisions of the GTC, even if it persists for some time, does not prevent either party from requesting the faithful and literal application of the GTC's provisions. If any provision of the GTC is declared void or invalid, that provision will be considered separable, and the other provisions will remain fully effective.
These GTC are expressly agreed and accepted by the Client, who declares and acknowledges having perfect knowledge of them, and therefore waives reliance on any contradictory document, including its own general terms and conditions of purchase.
The provisions of these GTC apply subject to compliance with mandatory provisions relating to unfair clauses.
